By visiting the South African Wine Cellar’s website and/or purchasing goods from us, you engage our Services, as further defined below, and consent to and agree to be bound by the following terms and conditions (the “Terms”), including our Privacy Policy, Return Policy, Delivery Policy and any additional terms and conditions and policies referenced. 

If you do not agree to all of the Terms of this agreement, you may not access the website or use any of our Services.

We reserve the right to update, change or replace any part of these Terms by posting updates and/or changes to our website and/or by emailing you.

Services

The South African Wine Cellar sells South African wine exclusively via its website and delivers any purchases to the address indicated in your order (the “Services”). We shall not be liable to provide any other services whatsoever.

The products displayed on our website may be limited in quantity and are subject to return or exchange in accordance with our Return Policy.

We do not warrant or guarantee that:

  •  the quality and/or taste of any of our products and/or Services will meet your expectations or taste – our products and Services are of merchantable quality and fit for purpose within the meaning of the Sales of Goods Act;
  • all of our products and services will be available at all times or that the availability of our website and/or Services will be uninterrupted, timely, secure or error-free;
  • any errors in our Service will be corrected and/or that the use of our website and/or Services will be free from errors; and
  • your computer or mobile phone will display colours and images of our products accurately.

We reserve the right to:

  • limit our Services;
  • refuse to provide our Services entirely to any person, geographic area or jurisdiction at our sole discretion for any reason whatsoever;
  • limit or cancel any purchases made by you at our sole discretion; and
  • prohibit any orders made that in our judgment are or appear to be made by resellers, distributors or dealers providing the same or similar services to us.

Access to our website and our Services is permitted on a temporary basis, and we reserve the right to withdraw or amend access to our website and our Services without notice.

We will not be liable if, for any reason whatsoever, our website or our Service is unavailable at any time or for any period. From time to time, we may restrict access to some parts of our website or our Service, or our entire website or Service, to users who have registered with us.

By accessing our website and engaging our Services, you undertake to provide accurate and complete information for all purchases made from us.

Price and Service Amendments

  • not access our Services/website without authority, or interfere with, damage or disrupt any part of our website or our Services or any network or equipment used in the provision of our Services.

You undertake not to sell, resell, reproduce, copy, use or exploit in part or whole any of our Services and/or our website without our express written consent, and you are prohibited from using our Services/website for any illegal or unauthorised purposes.

In the use of our Services/website, you shall not break any laws whatsoever of the jurisdiction you reside in and/or cause the South African Wine Cellar to be in breach of any laws whatsoever.

Age-Restricted Products

By accessing our website and/or placing an order, you affirm that you are 18 or above and legally permitted to consume alcohol.

Products restricted by age, such as alcohol, can only be sold and delivered to a person aged 18 or above.

The South African Wine Cellar operates the Challenge 25 age verification policy whereby customers who look under aged 25 will be asked to provide proof that they are aged 18 or over. The driver may refuse to deliver an age-restricted product to any person who does not look aged 25 unless they can provide a valid photo ID proving that they are aged 18 or over.

The South African Wine Cellar is the owner of or the licensee of all intellectual property rights in: (i) our website, (ii) our Services; and (iii) any material published by the South African Wine Cellar and on its website. You may not copy, reproduce, republish, download, post, broadcast, transmit, make available to the public or otherwise use any content on our website or any material published in any way except for your own personal, non-commercial use.

We do not guarantee that our Services and/or our website are free from typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, offers, delivery charges, delivery times and availability.

We reserve the right to correct any errors, inaccuracies or omissions and to cancel orders if any information in the Services or on our website is inaccurate at any time without prior notice to you, even after you have submitted your order.

Any material or information, including historical information, displayed on our website or marketing material is not intended to be advice on which reliance should be placed. We, therefore, disclaim all liability and responsibility arising from any reliance placed on such material and information published on our website or marketing material.

If the limitation or exclusion for consequential or incidental damages is not permitted by law, our liability shall be limited to the maximum extent permitted by law.

You agree to indemnify, defend and hold the South African Wine Cellar and its subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers and employees harmless from any and all claims or demands, including reasonable legal fees, made by any third party due to or arising out of your breach of these Terms, or your violation of any law or the rights of any third parties.

Termination

If we have reason to believe that you are in breach of any of these Terms, we reserve the right to terminate our Services and/or prohibit you from accessing our website with immediate effect.

You may terminate your agreement with us at any time, at which point you will no longer be entitled to access our website and/or our Services.

The liabilities and obligations of the parties under these Terms will survive the termination of this agreement.

We reserve the right to modify, amend or vary any Terms, and we shall publish said modifications, amendments or variations on our website. It is, therefore, your duty to check our website on a regular basis.

Applicable law and jurisdiction 

This agreement is governed by and shall be construed in accordance with the laws of Singapore.  Any dispute arising out of or relating to the Terms and/or Services, including any question regarding the existence, validity or termination of the Terms and/or Services, which cannot be amicably resolved, shall be subject to the jurisdiction of the Singaporean Courts.
